AGREEMENT TERMS AND CONDITIONS
These terms and conditions govern your use of www.hyveheadsets.com and the purchase of products through the site. By using the site or placing an order with Hyve Headsets LLC, you agree to these terms and conditions. Hyve Headsets LLC may make changes to the site and these terms and conditions at any time.
YOUR ORDER & AGREEMENT
Your order represents an offer to purchase products listed in your order on the terms and conditions outlined in this agreement. The agreement will be formed when Hyve Headsets LLC accepts your order through confirmation or ships the ordered products to you, whichever occurs first. The use of any payment does not constitute acceptance by Hyve Headsets LLC.
You confirm that you have the authority to enter into this agreement on behalf of yourself or any party you represent.
This agreement may not be altered or amended by any other document unless agreed to in writing by both you and Hyve Headsets LLC.
VALIDITY OF PROVISIONS
If any provision in this agreement is deemed invalid by a government law or court, the rest of the agreement remains enforceable.
GOVERNING LAW
The sale of products in the United States is governed by the laws of the state of California, excluding California's conflict of law provisions.
Revised Payment Terms:
Hyve Headsets LLC only accepts credit cards listed on the product ordering screens as payment options for your purchase. Your credit card will not be charged until the products in your order are shipped.
Shipping and Handling Charges:
Shipping charges will be added to the cost of the products. Hyve Headsets LLC only accepts orders from billing and shipping addresses located within the 50 United States, the District of Columbia, Canada, and specific European countries listed on the product ordering screens. Not all prices include charges for shipping, handling, or VAT. These additional charges will be reflected on the invoice. Hyve Headsets LLC reserves the right to limit quantities.
Taxes:
You are responsible for paying all applicable taxes, including local, city, state, and/or country taxes. Hyve Headsets LLC offers VAT back to parties who provide evidence of their VAT registration in the country to which the order was shipped. More information is available in the FAQs.
Product Title:
Upon delivery of the products to the first common carrier, title and risk of loss will pass to you.
Account Access:
You agree not to misuse or abuse account access and passwords and to take reasonable precautions to keep your password confidential.
Capacity to Contract:
You represent that you are of legal age of majority in your state or country of residence or authorized by your employer to use this site.
Governmental Authorizations:
You are responsible for obtaining any necessary licenses or government authorizations related to the use of the products and for complying with related rules and regulations. Hyve Headsets LLC and its employees are not your agent or representative in government matters.
WARRANTY
The Limited Warranty for the products you purchase under this agreement is described on the site and is included in the documentation that comes with the product. Hyve Headsets LLC only provides the standard limited warranty and denies all other implied warranties, including those for merchantability and fitness for a specific purpose. However, some countries may not allow limitations on implied warranties, so these restrictions may not apply to you. Hyve Headsets LLC reserves the right to change its warranties at any time.
COMPLIANCE WITH RETURN POLICIES
You are expected to comply with the return policies for any products you purchase through the site. The current return policy, which can be found in the Customer Service section, is a part of these Terms and Conditions and is referred to as the "30 Day Return Policy.”
PRODUCTS
Hyve Headsets LLC continuously updates and revises its products. The company may discontinue certain products or ship products with similar functionality as the ones ordered, and reserves the right to do so without prior notice. Product availability may be indicated on the site, but cannot be guaranteed, and products may not be immediately available for delivery.
DISCLAIMER AND LIMITATION OF LIABILITY AS TO THIS SITE
This site may contain outdated information, inaccuracies, or errors, and is provided "as is." Hyve Headsets LLC makes no warranties, express or implied, regarding the site or its contents. The company also cannot endorse or guarantee the accuracy of third-party content that may be made available on the site.
COMPLIANCE WITH THE LAW; RESALES NOT INTENDED
Hyve Headsets LLC and its directors, officers, employees, or other representatives will not be held liable for any damages resulting from the use or operation of this site. This limitation of liability applies to all types of damages, including direct, indirect, compensatory, special, incidental, punitive, and consequential damages, as well as loss of profits, revenue, data, and use.
You are required to comply with all applicable laws and regulations relating to the products or this agreement and represent that you are purchasing the products for personal use and not for resale. Separate terms and conditions apply to purchases made for resale.
EXPORT REGULATION COMPLIANCE
The hardware, software, and technology provided to you are governed by the U.S. Export Administration Regulations and may be subject to similar regulations in other countries. You are obligated to comply with both the U.S. Export Administration Regulations and any other relevant regulations in regards to your use, re-export and receipt of the hardware, software, and technology. This compliance clause will remain valid even after the contract is terminated.
LAW COMPLIANCE AGREEMENT
You promise to abide by all relevant laws, regulations, and policies regarding your use of this website and any products or services you purchase through it. In our discretion, we may report any perceived violations to the proper authorities. If we become aware of any suspected violations of these terms, conditions, or privacy policy, we may launch an investigation to determine the scope of the violation and take appropriate action, including temporarily suspending service to the affected customer and removing material from our servers. You agree to fully cooperate with any investigation. You acknowledge that violating these regulations can result in legal consequences.
